Can I register a logo as a trademark?

In terms of the UK Trade Marks Act the definition of a trade mark is “any sign capable of being represented graphically which is capable of distinguishing goods or services of one undertaking from those of another”.

A trademark may, in particular, consist of words (including personal names), designs (i.e. logos), letters, numerals or the shape of goods or their packaging.

A logo is a graphic representation and provided it is distinctive it does fall within the definition of a trademark. One can therefore register a logo as a trademark.

In practice most trademark owners register a logo in conjunction with a word mark. These are usually referred to as composite marks. As a general rule where a word mark and logo are involved it is better to register them separately as this would give you the best protection. However there are circumstances when word marks must be filed in logo format in order to make them acceptable. There are also circumstances where word marks should not only be registered in logo format as this would reduce the protection afforded to them. The general rules therefore vary according to the individual circumstances of each case and it is recommended that you seek expert advice prior to registering a logo.
